1) Scope & Who can use this page

This policy applies to content hosted or indexed on StockDokan, including marketplace item pages, previews, and downloadable files. If you are a rights holder or an authorized agent and believe your work has been used without permission, follow the steps below.

2) Designated Agent (Contact)

Send notices and counter-notices to our designated agent:

For fastest handling, use email with the subject line “DMCA Notice” or “DMCA Counter-Notice”.

3) How to submit a DMCA Takedown Notice

To file a valid DMCA notice (17 U.S.C. §512(c)(3)), include all items below. Incomplete notices may be rejected.

  1. Your contact information: full legal name, organization (if any), postal address, phone, and email.
  2. Identification of the copyrighted work you claim is infringed (URL to the original or a clear description).
  3. Identification of the material you claim is infringing on StockDokan, including specific URLs or seller/item IDs.
  4. A statement of good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. The following statement: “I swear, under penalty of perjury, that the information in this notice is accurate and that I am the copyright owner or authorized to act on behalf of the owner.”
  6. Your physical or electronic signature (typing your full legal name is acceptable for email submissions).

4) How to submit a Counter-Notice

If your content was removed due to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notice (17 U.S.C. §512(g)(3)). Include:

  1. Your contact information: full legal name, postal address, phone, and email.
  2. Identification of the material that has been removed or disabled and the location where it appeared before removal (provide URLs, item IDs).
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your consent to the jurisdiction of the Federal District Court for your address (or Orange County, California if outside the U.S.) and acceptance of service of process from the original complainant.
  5. Your physical or electronic signature (typing your full legal name is acceptable for email submissions).

5) Repeat Infringer Policy

In appropriate circumstances, StockDokan may suspend or terminate accounts of users or sellers who are deemed repeat infringers. We may also limit features, withhold payouts, or remove portfolios pending investigation.

6) Removal & Restoration Process

  1. Notice received: We review for completeness. If valid, we disable access to the content and notify the uploader.
  2. Counter-notice window: The uploader may submit a counter-notice. If none is received, the content will remain disabled/removed.
  3. If counter-notice received: We forward it to the original complainant. Unless we are informed of court action within 10–14 business days, we may restore the content.

We may disclose notices and counter-notices (with personal info redacted where possible) to the parties involved or to legal authorities as required.

7) Abuse & Misrepresentation

Submitting false claims or misrepresentations may lead to account suspension and legal liability, including costs and attorneys’ fees under 17 U.S.C. §512(f).

8) Outside the United States

We operate worldwide and will consider notices under applicable local laws. If your claim is not based on U.S. law, include the specific legal basis and jurisdiction. We may still follow the procedural framework outlined above for consistency.

9) Changes

We may update this policy. The “Last updated” date will be revised, and we will provide additional notice where appropriate.
